Protective Orders in MarylandWHAT IS A PEACE ORDER (also referred to as a restraining order)?

A peace order is a civil protection order that must be filed in the District Court of Maryland.

There are three types of peace orders
(also referred to as restraining orders) :

  1. Interim peace orders
    An Interim Peace Order is filed at the Commissioner's Office only when the District Court clerk's office is NOT open for business (for example, on the weekends, evenings, or holidays) and is effective only until a hearing for a temporary peace order, which would generally be held on the next day that the District Court is open.
  2. Temporary peace orders
    A hearing will be scheduled and held on the temporary order and the Respondent (recipient of the order) may or may not be present. The Temporary Order is effective for up to 7 days after the order is served (but it can be extended for up to 30 days). If both the Petitioner and Respondent agree, the Court may go to a Final Hearing on the date of the Temporary Order hearing.
  3. Final peace orders
    A Final Peace Order can be effective for up to six (6) months. The standard of proof at the final hearing is clear and convincing evidence.
